The features offered include, in particular:
- Display of live football scores
- Integration of an OBS overlay
- Automated Twitch chatbot features
- Selection of supported football competitions
- Individual settings and configuration options
Certain features may be offered free of charge.
Extended features may require a paid Premium subscription.
The specific scope of services is determined by the product description displayed before the contract is concluded.
Section 3 Registration
Certain features require users to sign in through Twitch.
Users must use the platform exclusively in compliance with applicable laws and the terms of use of integrated third-party providers.
Misuse of user accounts or technical features is prohibited.
Section 4 Premium subscription
GoalPulse offers a paid Premium subscription with monthly billing.
The applicable price is displayed before the contract is concluded.
Payment is processed through the payment service provider Stripe.
Premium features are activated immediately after successful payment processing.
The subscription automatically renews for a further month at a time unless cancelled beforehand.
The applicable payment and contractual terms are displayed before the subscription is purchased.
Section 5 Conclusion of the contract
The presentation of paid services on GoalPulse does not constitute a binding contractual offer.
Before placing an order for a paid service, the user is shown the essential contractual information.
This includes, in particular:
- Scope of services
- Total monthly price
- Billing interval
- Contract duration
- Cancellation terms
The user places their order with an obligation to pay through the designated ordering process.
The contract is concluded when the provider accepts the order.
The conclusion of the contract is confirmed electronically.
Section 6 Contract duration and cancellation
The Premium subscription is concluded for an indefinite period with monthly billing.
Users may cancel their subscription at any time using the cancellation feature provided.
Ordinary cancellation takes effect at the end of the current billing period.
Until then, the Premium features already paid for remain available.
Once cancellation takes effect, no further regular subscription renewals take place.
The right to extraordinary termination for good cause remains unaffected.
Section 7 Right of withdrawal
Consumers generally have a statutory right of withdrawal for distance contracts.
Information on this is provided in the separate withdrawal instructions.
Immediate activation of Premium features does not automatically extinguish the right of withdrawal.
Where permitted by law, withdrawal may give rise to an obligation to pay reasonable compensation for services already provided.
Section 8 Availability
GoalPulse endeavours to operate the platform reliably and with as few interruptions as possible.
Temporary limitations may arise, in particular, due to maintenance, technical faults or failures of external interfaces.
GoalPulse depends in part on the availability of external services such as Twitch and sports data providers.
Statutory rights in the event of failure to supply or defects in digital services remain unaffected.
Section 9 Sports data and results
The football information displayed on GoalPulse originates wholly or partly from external data providers.
Despite careful processing, delays, technical errors or discrepancies may occur.
It cannot be guaranteed that all sports information is up to date in real time at all times.
Statutory warranty rights remain unaffected.
Section 10 Permitted use
GoalPulse may be used exclusively within the scope of its intended features.
The following are prohibited in particular:
- Unauthorised access to systems or user accounts
- Circumvention of technical safeguards
- Manipulation of the platform
- Actions that significantly impair operation
- Unlawful use of content provided
In the event of material breaches of contract, appropriate measures may be taken, up to and including suspension of the user account.
Users' statutory rights remain unaffected.
Section 11 Liability
The provider has unlimited liability for intent and gross negligence and for damage arising from injury to life, limb or health.
In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract.
Mandatory statutory liability provisions remain unaffected.
Section 12 Changes to services and these Terms and Conditions
Changes to the platform and these Terms and Conditions are made exclusively within the applicable statutory and contractual requirements.
Where the user's consent is required, it will be obtained.
Consumers' statutory rights in the event of changes to digital products remain unaffected.
Section 13 Applicable law
The law of the Federal Republic of Germany applies.
For consumers, mandatory consumer protection provisions of the country of their habitual residence remain unaffected.
